We kindly ask you to carefully read the following terms and conditions, they bind you with the Merchant, owner of the Site. In addition, you thereby accept the electronic mode of communication with the Merchant for all of your exchanges and that these meet all the requirements of written communication.
We reserve our sole discretion to refuse to serve you, to cancel an order, to close your account, to delete or modify the content of the Site or to cancel an order whether or not you have complied with these Terms and Terms.

The products and services offered are intended to be sold to adults who have reached majority in your place of residence, i.e. 18 years of age in the province of Quebec. By using the Merchant's Site, you represent and warrant that you are of the age of majority in your place of residence.
Accuracy of information
We do everything in our power to ensure that all information published on our Site is error-free, but we cannot guarantee this fact. We may refuse or cancel an order containing an item with an incorrect description or price. Unless otherwise indicated, prices are quoted in Canadian currency.
The products offered on our Site as well as the dates of offers, prices and availability, characteristics and technical specifications of these products are subject to revision and change without notice. It is possible that a product ordered online is no longer available in our inventory or that it cannot be delivered due to a situation beyond our control. We will then proceed to cancel the order and refund the sums paid in return, if this is the case.
Your only recourse in the event of non-conformity of the description of a product is to return it in its original packaging for refund, in accordance with the refund provisions which apply below.
Regular Prices
Unless otherwise indicated, list prices (suggested prices) of products appearing on the Site represent the retail price suggested by the manufacturer or supplier or estimated in accordance with industry commercial practices. When the sale of an item is offered by one of our merchants, the List Price or Suggested Price may be provided by the merchant for information purposes only.
Registration and password
You will need to complete a registration form to access certain parts and features of the Merchant Site. You agree to provide us with up-to-date and truthful information and to keep this information up to date at all times.
You agree to protect the confidentiality of your user name and password as well as access to your computer, so that no other person uses it. You are responsible for all transactions made in your account using this information. You must immediately notify us of any unauthorized use of your username and password and any breach of security of which you become aware, and within forty-eight (48) hours of becoming aware of such situation.
Comments
You have the possibility of registering comments and criticisms relating to the content of the Site. You are fully responsible for the comments you post, we are not responsible for them and you agree to indemnify the Merchant against any damage resulting from them.
It is prohibited to make statements on behalf of others, to conceal your identity or to make statements that are unlawful, obscene, threatening, defamatory or infringing on the privacy or intellectual property of any person or constitute chains letter, direct mail or spam.
We reserve the right, but have no obligation, to edit or remove comments without explanation, and we assume no responsibility for systematically revising any comments posted.
When you post a comment, you give the Merchant the non-exclusive right to use the name and the published content, royalty-free, perpetually and irrevocably, to reproduce, modify, adapt, publish, represent it , translate it, distribute it, communicate it to the public and display it anywhere in the world and on any medium.
We ask that you post only one review per product, unless you want to add new information. You agree to only comment on products that you have personally tried, maintaining a respectful tone at all times. Employees and competitors of distributors and manufacturers are prohibited from posting comments.
Applicable laws
These terms and conditions are governed by the laws of the province or state of Quebec or the country of Canada applicable to it. In addition, any legal action against the Merchant must be brought before the judicial district of Terrebonne.
Order errors
In the event that you believe that an error has occurred when placing an order, we invite you to notify us without delay, but at the latest within 48 hours of its discovery by sending us a message at the following address: g.energiecanada@gmail.com and indicating in sufficient detail the error that has been made.
Delivery and statuses
We reserve the right to choose the carrier which will be the fastest according to the option chosen if the latter allows the delivery of your order within the same time or more quickly. In all cases, the carrier will be determined by the merchant.
Our usual delivery times, depending on the type of delivery chosen (Expedited/Express) in your territory, are:
2 to 10 days* > Quebec and Ontario
3 to 10 days* > Manitoba, Saskatchewan, Alberta, British Columbia, New Brunswick, Newfoundland and Labrador

Each order is shipped in 1 single shipment. In the event that one or more products should be ordered, your order will be sent to you when all the products are in stock.
You can check the status of your order at any time by logging into your account.
We undertake to deliver your purchases to you within a reasonable time subject to the availability of the various suppliers and carriers used by the sender, who are solely responsible for the delivery of the products or services purchased.
Free shipping is offered on parts and accessories for orders over $99, under certain conditions
You must reside in Canada, in the province of Quebec
Not applied to vehicles, some e-bikes and carts
Risk of loss and title to the purchased good or service passes to you when it is handed over to the carrier or if the goods cross an international border, such risk passes to you after customs clearance.
In this case, the risk of loss and the right of ownership of the goods purchased pass to you when you take possession of them at the store.
Exchange, Return, Exchange or Refund Cancellation Policy
Cancellation: You can cancel the order of a good that does not suit you. In this case, you must inform us of the problem that prompts you to cancel the order with our customer service and obtain prior consent to cancel the order.
Returns and Exchanges: ENERGY CANADA GROUP accepts returns or exchanges within 30 days of purchase date on most new and resalable items. Electrical, liquid and Gasquet items cannot be returned. Returns/refunds of items will be subject to a return/refund fee which will vary depending on the product (20-50%). Shipping charges are non-refundable upon return and the cost of shipping returned items is the customer's responsibility.
Refund: no refund but if a good does not work. In this case, you must notify us of the problem affecting your product within 48 hours of receipt of the latter from our customer service department and obtain a repair authorization. Thereafter, you must, if required by the Merchant, ship the goods to the distributor's address in order to obtain a repair.
All returned products must be in their original packaging.
You can return your purchase in store during our normal business hours.
In all cases where a return of goods is required by the Merchant, the right of ownership of returned goods is only transferred to him when it has been received by him at his physical place of business.
Exceptions: All vehicles have a 30 day warranty on engines only.
Disclaimer of Warranty
SUBJECT TO APPLICABLE LAW, THE MERCHANT DISCLAIMS ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED AS TO THE TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE PRODUCTS AND SERVICES SOLD ON THE SITE. IT ALSO EXCLUDES ANY WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, IN THE CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR THROUGH THE SITE AND ON ITS SERVERS AND IN THE ELECTRONIC COMMUNICATIONS.
Limitation of Liability
THE MERCHANT SHALL NOT BE HELD RESPONSIBLE FOR ANY DIRECT OR INDIRECT DAMAGES, RESULTING FROM THE USE OR MISUSE OF THE SITE OR FOR THE PURCHASE OF ANY SECURITY THEREOF, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFIT, USE OF DATA OR OTHER INTANGIBLES, EVEN IF MERCHANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The copyrights and Trademarks contained in the information published on the Site are protected by the laws relating to intellectual property and are made available on the Site by the granting of a specific license in this regard.
In accordance with the laws relating to intellectual property in force, it is prohibited to use, display or exhibit any trademark, copyright or any other protected work accessible on the Site for any reason other than to proceed to the sale of these products and services without the right to grant sublicenses to third parties. The owners of the marks appearing on the Site retain all rights not expressly granted in these Terms and Conditions.
